Small Claims Panel

A Small Claims Panel (SC Panel) was established on 17 August 2010 on issuance of the ‘Tribunal Practice Direction No. 2 of 2010 – Establishment of a Small Claims Panel’ in accordance with article 2(c) of Decree  No. 11 of 2010 – Amending Decree No. 57 of 2009

The following Judges were appointed as the Members of the SC Panel:

·     HE Justice Omar Al Muhairi (of the DIFC Courts);

·     HE Justice Ali Al Madhani (of the DIFC Courts);

·     HE Justice Dr. Jamal Hussain Alsumaity (of the Dubai Courts); and

·     HE Justice Abdulla Ahmed Alkaytob (of the Dubai Courts) who no longer is a member and in 2013 Sir John Chadwick Deputy Chief Justice of the DIFC Courts was appointed in his place.

The SC Panel was created to fast track claims below AED 500,000 in value, and to handle employment related disputes that can be resolved on an expedited basis Consultations are held in a meeting room, before a SC panel Member and in private without involving lawyers, as oppose to a hearing in a courtroom in public presence.

The SC Panel Member works towards encouraging negotiation and settlement of the dispute amicably between the parties. If the parties are not able to reach an agreement, however it seems it maybe likely, a second consultation is fixed before the same SC panel member to further encourage settlement. If no agreement has been reached then the SC Panel Member may direct that a hearing be listed before a 3 Members SC panel or be referred to the Tribunal for a decision to be made.
